General Terms and Conditions – Bicycle Rental Zwaan Bikes Rotterdam
Article 1 – Definitions
• Lessor: The company renting out the bicycle(s).
• Lessee: The natural or legal person entering into a rental agreement with the lessor.
• Bicycle: The vehicle being rented, with an estimated value of €600 for the 3-speed city bike, €1500 for the electric VanDijck, and €3500 for the Roetz Life and Riese & Müller UBN models.
• Insurance: Optional theft insurance covering the value of the bicycle, minus an excess of €50 (city bike) or €150 (e-bikes). Only possible to choose before renting and is valid when key of the stolen bike can be shown. Otherwise it's off the table
Article 2 – Rental Prices and Reservations
• Online reservation: When booking via the website, the lessee receives a €2.50 discount per calendar day on the regular rental price.
• Rental period: The rental is calculated per calendar day, regardless of the time of pick-up or return.
• On account: When renting on account, the rental fee must be paid by bank transfer at least two working days prior to the rental date. In addition to the surcharge of €2.50 per bicycle per day, an administration fee of €17.50 will be added to the invoice. Bank payments without an invoice reference may be processed too late, making the rental invalid on the chosen date.
Article 3 – Insurance and Liability
• Theft insurance: The lessee can opt for theft insurance at €2.50 per calendar day. This covers the bicycle’s value (€600) minus an excess of €50, or the value of the relevant e-bike minus a €150 excess. The insurance is only valid upon presentation of the bicycle key (proof of locking)
• Without insurance: If the lessee does not take out insurance or cannot provide the bicycle key in case of theft, they are liable for the full value of the bicycle (€600) or the applicable e- bike value mentioned above.
• Damage: Damage to the bicycle is not insured. The lessee is liable for all damages unless reported and recorded before the start of the rental. Theft of parts/battery is also considered damage. Flat tires are not considered damage.
• Injury/damage: The lessor is not liable for any injury or damage caused by the use of the rented bicycle.
• Helmet use: Wearing a helmet is recommended but not mandatory.
Article 4 – Condition of the Bicycle
• Inspection at start: The lessee must inspect the bicycle at the start of the rental period and immediately report any defects to the lessor.
• Return: The bicycle must be returned in the same condition in which it was received, excluding normal wear and tear.
Article 5 – Cancellation
• Free cancellation: Cancellation is free of charge up to 24 hours before the start of the rental period.
• Within 24 hours: For cancellations made within 24 hours before the start of the rental period, the full rental amount is due.
• Same-day cancellation: Cancellations on the day of the rental are not possible; the full rental amount is due.
Article 6 – Use of the Bicycle
• Purpose: The bicycle may only be used for recreational purposes and on paved roads. 1 adult per bike and child transport only in a childseat
• Prohibited use: It is not permitted to use the bicycle for races, off-road riding, or while under the influence of alcohol or drugs.
• Lock use: The lessee is required to always lock the bicycle using the provided locks.
Article 7 – Identification and Deposit
• Identification: The lessee must present valid identification when collecting the bicycle.
• Deposit: The lessor may require a deposit depending on the type of bicycle. This deposit will be refunded upon return of the bicycle in good condition.
Article 8 – Other Provisions
• Applicable law: Dutch law applies to this agreement.
• Disputes: Disputes arising from this agreement will be submitted to the competent court in Rotterdam.
Article 9 – Returning the Bicycle
• The bicycle must be returned at the agreed date and location before 5:30 PM, unless otherwise agreed.
