General Terms and Conditions for Bicycle Rental – Zwaan Bikes Rotterdam
Article 1 – Definitions
• Renter: The company renting out the bicycle(s).
• Client: The natural or legal person entering into a rental agreement with the renter.
• Bicycle: The rented vehicle, with an estimated value of €600 for the 3-speed city bike, €1500 for the electric VanDijck, and €3500 for the Roetz Life and Riese & Müller UBN models.
• Insurance: Optional theft insurance covering the value of the bike, minus a deductible of €50 (city bike) and €150 (e-bikes).
Article 2 – Rental Prices and Reservations
• Online reservation: Clients booking through the website receive a discount of €2.50 per calendar day on the regular rental price.
• Rental period: Rental is calculated per calendar day, regardless of pick-up or return time.
• On account: If renting on account, the rental fee must be paid via bank transfer at least 2 working days prior to the rental date. An additional €2.50 per bike/day will be charged, plus a €17.50 administration fee. Bank payments without an invoice reference may not be noticed in time, rendering the rental invalid on the intended date.
Article 3 – Insurance and Liability
• Theft insurance: Theft insurance is included in the rental price. It covers the value of the bike (€600) minus a €50 deductible, or the value of the e-bike minus a €150 deductible. Valid only upon presentation of the bike key.
• No key: If the client cannot provide the bike key, they are liable for the full value of the bicycle (€600 or the stated e-bike value).
• Damage: Damage to the bicycle is not covered by insurance. The client is liable for all damages unless reported and documented before the start of the rental. Theft of parts/battery is also considered damage. Flat tires are not classified as damage.
• Injury/damage: The renter is not liable for any damage or injury resulting from use of the rented bicycle.
• Helmet use: Helmet use is recommended but not mandatory.
Article 4 – Condition of the Bicycle
• Inspection at start: The client must inspect the bicycle at the beginning of the rental period and report any defects immediately to the renter.
• Return: The bicycle must be returned in the same condition as received, excluding normal wear and tear.
Article 5 – Cancellation
• Free cancellation: Cancellation is free of charge up to 24 hours before the rental period starts.
• Within 24 hours: For cancellations within 24 hours before the rental period begins, the full rental fee is due.
• Same-day cancellations: Cancellation on the start date of the rental period is not possible; the full rental fee is due.
Article 6 – Use of the Bicycle
• Purpose: The bicycle may only be used for recreational purposes and on paved roads.
• Prohibited use: It is not allowed to use the bike for racing, off-road riding, or under the influence of alcohol or drugs.
• Lock usage: The client is required to lock the bicycle at all times using the provided locks.
Article 7 – Identification and Deposit
• Identification: The client must present a valid ID when collecting the bicycle.
• Deposit: A deposit may be required, depending on the type of bicycle. This deposit will be refunded upon return of the bicycle in good condition.
Article 8 – Other Provisions
• Governing law: This agreement is governed by Dutch law.
• Disputes: Any disputes arising from this agreement will be submitted to the competent court in Rotterdam.
Article 9 – Returning the Bicycle
• The bicycle must be returned on the agreed date and location before 17:30, unless otherwise agreed.
• The renter is not able to collect the bicycle in case of breakdown. As unfortunate as it may be, the client is responsible for returning the bicycle.
